Terms of Service.

The agreement between you and Tieghtsuite for using the Service — no contracts, no fine print, but the terms that matter, written straight.

01 · The agreement

These Terms of Service ("Terms") govern your access to and use of the Tieghtsuite website and software ("the Service"). By creating an account or using the Service, you agree to these Terms. If you are agreeing on behalf of a business, you confirm you are authorised to bind that business.

Your privacy is covered separately in our Privacy Policy, and our data-protection commitments in Data Protection (DPA, 2019).

02 · Your account

You must provide accurate, current information — your name, business name, and a WhatsApp number where we can reach you.
You are responsible for keeping your login credentials confidential and for everything done under your account.
Tell us immediately at hello@tieghtsuite.com if you suspect unauthorised use of your account.
The Service is for business use. You must be at least 18 to use it.

03 · Free trial & subscription

New businesses get a free 14-day trial. No card is required to start, and nothing is charged automatically when the trial ends.
When you subscribe, you pick a plan — Solo, SME, or Team — and pay monthly by M-Pesa Till. The price on the plan is the price you pay.
You can upgrade or downgrade at any time. Upgrades are not charged retroactively.
You can cancel at any time in two taps from your dashboard. On cancellation, paid-for access continues until the end of the current billing period.

04 · Billing & M-Pesa payments

Subscription payments are collected via M-Pesa Till through Safaricom's official API. We do not store your M-Pesa PIN or access your personal phone.
If a payment fails, we will notify you on WhatsApp; access to paid features continues during a short grace period.
Refunds are handled per the payment processor's policies. If we owe you a refund, we will issue it through the same channel you paid with.
Tax (including VAT, where applicable) is shown as part of the price or itemised on your invoice, as required by Kenyan law.

05 · Your data

You own your data. Your client lists, invoices, financials, and staff records are yours.
You grant Tieghtsuite a limited licence to host, process, and display your data solely to provide the Service to you.
You can export your data at any time, and request deletion when you close your account. We keep only what the law requires after that.
You are responsible for the accuracy of the data you enter and for meeting your own obligations to clients and staff — including under the Kenya Data Protection Act, 2019 — where you are the data controller of that information.

06 · Acceptable use

You agree not to use the Service to:

do anything unlawful or fraudulent;
process money, payroll, or records for a business you do not genuinely operate;
interfere with or attempt to gain unauthorised access to the Service, its systems, or other accounts;
resell, lease, or sublicense the Service without our written consent;
upload or store content that breaches any law or any person's rights.

07 · Third-party services

The Service integrates with third parties — including Safaricom (M-Pesa), Pesapal, WhatsApp, and email providers — that have their own terms and privacy policies. We are not responsible for those third parties' services, and your use of them is governed by their terms. We integrate with them through official APIs and never with your personal credentials.

08 · Our intellectual property

The Service, its code, design, trademarks ("Tieghtsuite"), and content are owned by or licensed to Tieghtsuite. Nothing in these Terms transfers ownership to you. You may use the Service only as these Terms allow.

09 · Disclaimers

The Service is provided "as is" and "as available". We work hard to keep it reliable, but we do not guarantee that it will be uninterrupted or error-free.
Tieghtsuite is not legal, tax, or accounting advice. Reports and invoice formats are tools — your accountant remains your authority on your books and filings.
We are not liable for the acts or omissions of third-party services we integrate with.

10 · Our liability

To the fullest extent permitted by law, Tieghtsuite's total liability to you for any claim arising out of these Terms or the Service is capped at the amount you paid us in the twelve months before the claim.
We are not liable for indirect, incidental, or consequential loss, loss of profits, or loss of data, except where the loss results from our fraud, wilful misconduct, or where liability cannot be limited by law.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under Kenyan law.

11 · Suspension & termination

You can cancel at any time — two taps, no phone call, no retention call.
We may suspend or terminate access if you breach these Terms, use the Service unlawfully, or fail to pay for a paid plan after notice.
On termination, you can still export your data during the wind-down period. We then delete or anonymise personal data in line with our Privacy Policy and legal obligations.

12 · Changes to these Terms

We may update these Terms as the Service and the law evolve. Material changes will be highlighted when you sign in and become effective on the date stated. Continuing to use the Service after that means you accept the updated Terms.

13 · Governing law & disputes

These Terms are governed by the laws of Kenya. Any dispute will first be raised with us in writing at hello@tieghtsuite.com for a genuine attempt at resolution, and if unresolved, will be subject to the exclusive jurisdiction of the courts of Kenya.
